Floridians who purchased Costa sunglasses may be part of a Settlement

JACKSONVILLE, Fla., Oct. 12, 2026 /PRNewswire/ —

A Court authorized this Notice. This is not a solicitation from a lawyer.

A $21,750,000 Settlement has been reached in a class action lawsuit against Costa Del Mar, Inc. (“Costa”). The lawsuit alleges that: (i) Costa’s promise to repair sunglasses for a “nominal fee” was false, unfair, deceptive, and likely to mislead a reasonable consumer; and (ii) Costa breached the “nominal fee” warranty when it charged consumers more than a nominal fee to repair sunglasses damaged by accident, normal wear and tear, or misuse. Costa denies any wrongdoing or liability.

The purpose of this Notice is to provide information about the settlement and explain your rights and options.

Who is Included? The Settlement Class is defined as:

All citizens of the State of Florida who: (i) between July 28, 2013, and January 31, 2018, purchased non-prescription, non-promotional Costa sunglasses for personal use (Purchase Class) or (ii) were charged a fee by Costa between July 28, 2012 and January 26, 2025 to replace damaged components of their non-prescription, non-promotional Costa sunglasses (for sunglasses purchased on or before January 31, 2018) (Repair Class).

What Does the Settlement Provide?

If you are a Repair Class Member, you will automatically receive a pro rata (a legal term meaning equal share) cash payment from the Settlement Fund for each eligible repair. Your repairs must have exceeded $11.95.

If you are a Purchase Class Member, you can submit a Claim Form at www.CostaSunglassLitigation.com or by mail postmarked by January 11, 2027, to receive a pro rata (a legal term meaning equal share) cash payment from the Settlement Fund for each eligible purchase. Supporting documentation may be required to receive a cash payment for more than five (5) qualifying purchases.

$6,375,000 of the Settlement Fund will be allocated for the Purchase Class, and the remainder of the Settlement Fund will be allocated for the Repair Class after settlement administration costs and Class Counsel’s Attorneys’ Fees and Expenses have been deducted. You will receive an email to select whether to receive payment by paper check, Venmo, PayPal, or Zelle.

Other Options. If you do not want to be legally bound by the Settlement, you must submit an opt-out postmarked by January 19, 2027. If you do not opt-out, you will give up the right to sue and will release Costa and the Released Parties, as defined in the Settlement Agreement, about the legal claims in this lawsuit. If you do not opt-out, you may object to the Settlement and/or Attorneys’ Fees and Expenses by January 19, 2027. The Long Form Notice on the Settlement Website explains how to opt-out or object. If you do nothing, Repair Class Members will automatically receive a cash payment, while Purchase Class Members will not receive a cash payment and will be bound by the Settlement and any judgments and orders of the Court. The Court will hold a Final Approval Hearing on March 23, 2027, to consider whether to approve the Settlement, Class Counsel’s request for Attorneys’ Fees and Expenses in the total amount of $7,303,605 from the Settlement Fund, and any objections to the Settlement. You or your lawyer may attend and ask to appear at the hearing if you object, but you are not required to do so.
